In these Terms & Conditions, "Gleamy", "we", "us", and "our" refer to the service provider offering the Gleamy service. The Gleamy service is provided by Ayşe Bahar Çelik as a Sole proprietorship under the Gleamy brand.

2. Definitions

To ensure clarity throughout these Terms, the following definitions apply:

• "Gleamy", "we", "us", or "our" refers to the service provider of the Gleamy service. The scope of these references and full details about the service provider are set out in section 1 (Parties and service provider) above.
• "Service" refers to the Gleamy platform, including the website at gleamy.ai, mobile-optimized interfaces, and all related features and functionality.
• "User" or "you" refers to any individual or entity accessing or using the Service, including Event Hosts, Guests, and account holders.
• "Event Host" refers to the person or organization that creates an event, purchases a plan, and manages the event gallery.
• "Guest" refers to individuals who upload content to or access an event gallery via a shared link or QR code.
• "Content" refers to photos, videos, messages, and any other materials uploaded to or generated through the Service.
• "Account" refers to the registered user profile required to create events and purchase plans.
• "Plan" refers to the subscription package (Starter, Standard, Premium, or Custom) that determines event limits and features.

3. Eligibility and account requirements

To create an account and purchase plans on Gleamy, you must be at least 18 years old or the age of legal majority in your jurisdiction. By creating an account, you confirm that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at hello@gleamy.ai if you suspect unauthorized access.

Guests who upload content or use face search features are not required to create an account. However, Event Hosts are responsible for ensuring that Guests are appropriately informed about data processing when using certain features.

4. License and use of the Service

We provide Gleamy as a hosted service. When you purchase an event package or plan, you receive a limited, non-exclusive, non-transferable right to access and use the Service during the period and within the limits of your plan.

You may not resell, sublicense, or make Gleamy available to third parties as a standalone service without our prior written consent. You must not share account credentials or bypass plan limits, security controls, or access restrictions.

We reserve the right to modify, update, or discontinue features of the Service at any time. We will provide reasonable notice for changes that materially affect your use.

5. User content and intellectual property

You retain ownership of all Content you upload to Gleamy. By uploading Content, you grant Gleamy a limited, non-exclusive, worldwide license to store, process, display, and transmit your Content solely for the purpose of providing the Service.

This license includes the right to use AI-powered features (such as face recognition and content moderation) to process your Content. We do not use your Content for advertising, training AI models for unrelated purposes, or any purpose beyond delivering the Service.

You represent and warrant that you have all necessary rights and permissions to upload Content, including consent from individuals appearing in photos and videos where required by applicable law.

Gleamy's software, design, branding, trademarks, and all related intellectual property remain the exclusive property of Gleamy. These Terms do not grant you any ownership rights in the Service itself.

6. Acceptable use

You agree to use the Service in compliance with all applicable laws and these Terms. Prohibited activities include, but are not limited to:

• Uploading illegal, harmful, defamatory, or infringing content
• Uploading content depicting minors in inappropriate contexts
• Harassing, threatening, or abusing other users or Gleamy staff
• Attempting to bypass security measures, plan limits, or access controls
• Using the Service for unauthorized commercial purposes or resale
• Impersonating others or providing false information
• Interfering with or disrupting the Service's operation
• Scraping, data mining, or automated extraction of content

We use AI-powered content moderation to automatically detect and filter inappropriate content. Content flagged by moderation may be quarantined or removed without prior notice.

7. Third-party services

The Service relies on third-party providers for infrastructure, payment processing, and certain features. These include, but are not limited to:

• Cloud infrastructure providers (e.g., AWS) for hosting, storage, and AI processing
• Payment processors (e.g., Iyzico) for secure transaction handling
• Email delivery services for notifications and communications

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services, except as required by law.

8. Privacy and data protection

We take privacy seriously. We do not sell or rent your personal information. We process data to operate the Service, provide support, handle billing, prevent fraud, and comply with legal obligations.

Certain features—such as AI Face Find or Private gallery access—may involve processing biometric or sensitive data to help guests find their photos and control what they can view. Where required by law (including KVKK in Turkey and GDPR in the EU), Event Hosts are responsible for informing participants and obtaining necessary consents before enabling these features.

9. Payment, billing, and refunds

Plans and top-up purchases are billed at the time of purchase. Prices are displayed in your selected currency and include applicable taxes where required.

Events are time-bound, so refund eligibility depends on your event date and Service usage. You may request a refund before your event date and before substantial use of the Service, subject to our Refund Policy.

We reserve the right to change pricing with at least 30 days' notice. Price changes do not affect existing paid plans until renewal.

10. Warranty disclaimer

The Service is provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.

We do not guarantee uninterrupted or error-free operation, compatibility with all devices or browsers, or that the Service will meet your specific requirements. If you have questions about compatibility, contact us before purchasing.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities, arising from or related to your use of (or inability to use) the Service.

Our total liability for any claim related to the Service will not exceed the total amount you paid for the event plan and any additional purchases (such as top-ups) associated with the claim—unless applicable law requires otherwise.

Nothing in these Terms excludes or limits liability for fraud, gross negligence, willful misconduct, or any liability that cannot be excluded by law.

12. Account suspension and termination

We may suspend or terminate your access to the Service, or restrict certain features, if we reasonably believe this is necessary to protect users, the Service, or Gleamy. Reasons include, but are not limited to:

• Violation of these Terms or applicable law
• Abusive, harassing, or fraudulent behavior
• Uploading illegal or infringing content
• Unauthorized resale, redistribution, or credential sharing
• Attempts to bypass limits, security controls, or access restrictions

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes. If your account is terminated for cause, you are not entitled to a refund.

13. Dispute resolution

If you have a dispute or concern regarding the Service, we encourage you to first contact us at hello@gleamy.ai or via the contact form on the gleamy.ai homepage. We will make reasonable efforts to resolve the issue informally.

If we cannot resolve the dispute informally, you agree that any legal proceedings will be conducted in the courts specified in the Governing Law section below, unless mandatory consumer protection laws in your jurisdiction require otherwise.

14. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Ankara, Turkey, unless mandatory consumer protection laws in your jurisdiction grant you the right to bring proceedings in your local courts.

If you are a consumer in the European Union, you may also have rights under EU consumer protection regulations, which these Terms do not affect.

15. Force majeure

We are not liable for any failure or delay in performing obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, government actions, pandemics, power outages, telecommunications failures, or cyberattacks.

16. Severability and entire agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Ayşe Bahar Çelik (operating under the Gleamy brand as a sole proprietorship) regarding the Service. They supersede all prior agreements, understandings, and communications, whether written or oral.

17. Changes to these Terms

We may update these Terms from time to time to reflect changes in the Service, legal requirements, or business practices. When we make material changes, we will:

• Update the 'Last updated' date at the top of this page
• Notify you via email or through the Service at least 30 days before changes take effect (for material changes)
• Provide a summary of key changes where practical

Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you should stop using the Service before the changes take effect.
