These Terms & Conditions ("Terms") govern your access to and use of gleamy.ai and the Gleamy platform (the "Service"). By accessing or using the Service, creating an account, creating an event gallery, uploading content, purchasing an event plan, or using guest features, you agree to these Terms. If you do not agree, please do not use the Service. If you use Gleamy on behalf of an organization, client, venue, agency, or other third party, you confirm that you have authority to accept these Terms on their behalf.

1. Parties and service provider

In these Terms & Conditions, "Gleamy", "we", "us", and "our" refer to the service provider offering the Gleamy service. The Gleamy service is provided by Ayşe Bahar Çelik as a Sole proprietorship under the Gleamy brand.

2. Definitions

To ensure clarity throughout these Terms, the following definitions apply:

  • "Gleamy", "we", "us", or "our" refers to the service provider of the Gleamy service. The scope of these references and full details about the service provider are set out in section 1 (Parties and service provider) above.
  • "Service" refers to the Gleamy platform, including the website at gleamy.ai, mobile-optimized interfaces, event photo galleries, QR code and link-based access, uploads, downloads, AI Face Find, Private gallery access, digital guestbook, moderation, and all related features and functionality.
  • "User" or "you" refers to any individual or entity accessing or using the Service, including Event Hosts, Guests, account holders, planners, photographers, venues, agencies, and authorized team members.
  • "Event Host" refers to the person or organization that creates an event, purchases or manages an event plan, configures gallery settings, invites Guests, and manages the event gallery.
  • "Guest" refers to individuals who access an event gallery, upload content, view content, use AI Face Find, leave guestbook messages, or otherwise interact with an event through a shared link or QR code.
  • "Content" refers to photos, videos, guestbook messages, text, metadata, event details, cover images, and any other materials uploaded, submitted, displayed, processed, or generated through the Service.
  • "Event gallery" refers to a gallery created for a specific event, including public or private access settings, uploaded media, guest interactions, and related event features.
  • "Account" refers to the registered user profile required to create events, purchase event plans, manage galleries, and access account-level features.
  • "Event plan" or "Plan" refers to the paid event-based plan selected for an event, such as Starter, Standard, Premium, or any custom or future plan made available by Gleamy, including its applicable limits, features, upload window, access period, and storage capacity.
  • "Top-up" refers to an additional capacity, feature, or usage add-on purchased for an event plan, such as additional photo or video capacity where available.
  • "AI Face Find" refers to Gleamy’s face matching feature that helps Guests find photos they appear in within a specific event gallery.
  • "Private gallery" refers to an access setting that may limit gallery visibility and may use selfie-based or face-matching flows to personalize what a Guest can view, where enabled.

3. Eligibility and account requirements

To create an account and purchase event plans on Gleamy, you must be at least 18 years old or the age of legal majority in your jurisdiction. By creating an account or purchasing an event plan, you confirm that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at hello@gleamy.ai if you suspect unauthorized access.

Guests do not need an account to access a shared event gallery, upload permitted content, leave guestbook messages, or use certain guest features. However, Guests must use the Service lawfully and must respect the rights and privacy of others.

Event Hosts are responsible for ensuring that Guests, photographers, participants, and other individuals involved in an event are appropriately informed about the use of Gleamy, including any features that may involve personal data, face matching, or access controls.

4. License and use of the Service

We provide Gleamy as a hosted digital service. When you purchase an event plan or top-up, you receive a limited, non-exclusive, non-transferable right to access and use the Service during the applicable event plan period and within the limits of the selected plan.

You may not resell, sublicense, white-label, or make Gleamy available to third parties as a standalone service without our prior written consent. You must not share account credentials, bypass plan limits, misuse guest access, or attempt to avoid security controls, access restrictions, or payment requirements.

We may modify, update, improve, limit, or discontinue features of the Service from time to time. Where a change materially affects active paid event plans, we will provide reasonable notice where practical, unless the change is required for security, legal compliance, abuse prevention, or operational stability.

5. Event Host responsibilities

Event Hosts decide how their event gallery is configured, who is invited, which access setting is selected, whether Guests may upload content, and whether features such as AI Face Find or Private gallery access are enabled.

Event Hosts are responsible for providing appropriate notices to Guests, photographers, and participants, and for obtaining any permissions, consents, or authorizations required by applicable law before collecting, uploading, displaying, sharing, or enabling processing of event content.

If AI Face Find, Private gallery access, selfie-based access, or face matching features are enabled, Event Hosts must ensure that participants are informed in a clear and appropriate way. Where explicit consent is required by applicable law, it must be obtained separately from general acceptance of these Terms or the Privacy Policy.

Event Hosts must not use Gleamy to collect, publish, or distribute content in a way that violates privacy rights, intellectual property rights, child protection laws, publicity rights, contractual obligations, platform rules, or applicable laws.

6. User content and intellectual property

You retain ownership of Content you upload or submit to Gleamy. By uploading, submitting, or making Content available through the Service, you grant Gleamy a limited, non-exclusive, worldwide license to host, store, process, display, transmit, moderate, organize, and make that Content available solely as needed to provide, secure, support, and improve the Service.

This license includes the right to process Content using service-related features such as uploads, gallery display, downloads, sharing, AI Face Find, Private gallery access, content moderation, compression, backups, and technical processing required to operate the Service.

We do not sell your Content. We do not use event Content for advertising, public surveillance, cross-event tracking, or training unrelated AI models outside the purpose of providing and improving the Gleamy Service.

You represent and warrant that you have all necessary rights, permissions, and lawful bases to upload, share, display, or otherwise make Content available through the Service, including permissions from individuals appearing in photos and videos where required by applicable law.

Gleamy’s software, design, branding, trademarks, logos, user interface, documentation, and all related intellectual property remain the exclusive property of Gleamy or its licensors. These Terms do not grant you ownership rights in the Service itself.

7. Acceptable use

You agree to use the Service in compliance with all applicable laws, these Terms, and the rights of others. Prohibited activities include, but are not limited to:

  • Uploading illegal, harmful, defamatory, abusive, exploitative, or infringing content
  • Uploading, sharing, or requesting content depicting minors in inappropriate, exploitative, sexualized, or unsafe contexts
  • Harassing, threatening, abusing, impersonating, or misleading other users, Guests, Event Hosts, participants, or Gleamy staff
  • Uploading content without the rights, permissions, or lawful basis required to do so
  • Attempting to bypass security measures, payment requirements, plan limits, access settings, gallery restrictions, or face matching flows
  • Using the Service for unauthorized commercial resale, scraping, data mining, automated extraction, or unauthorized dataset creation
  • Introducing malware, harmful code, excessive load, spam, or other activity that interferes with the operation or security of the Service
  • Using Gleamy for unlawful surveillance, identification, profiling, discrimination, or other purposes unrelated to event photo sharing
  • Misrepresenting your relationship with Gleamy or using Gleamy branding without permission

We may use automated and manual moderation tools, including AI-powered content moderation, to detect and filter content that may violate these Terms, applicable law, or platform safety rules. Content flagged by moderation may be hidden, quarantined, restricted, or removed without prior notice.

8. Third-party services

The Service relies on trusted third-party providers for infrastructure, storage, payment processing, analytics, monitoring, communications, security, and certain technical features. These may include, but are not limited to:

  • Cloud infrastructure, storage, and processing providers for hosting, media storage, backups, and technical operations
  • Payment processors such as iyzico for secure transaction handling and payment verification
  • Email, notification, analytics, logging, monitoring, support, and security providers
  • AI, image processing, or content moderation providers where needed to provide specific Service features

Your use of third-party services may be subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, security, or practices of third-party services except as required by applicable law or where we are legally responsible for our processors or service providers.

9. Privacy and data protection

We take privacy seriously. We do not sell or rent your personal information. We process personal data to operate the Service, provide event galleries, support uploads and downloads, handle billing, provide support, prevent fraud and abuse, maintain security, and comply with legal obligations.

Certain features, such as AI Face Find, Private gallery access, selfie-based access, or face matching, may involve processing biometric data, special category data, or sensitive data depending on the jurisdiction and how the feature is used. Where required by applicable law, these features may require separate notice and explicit consent.

Event Hosts are responsible for informing participants and obtaining any required notices, permissions, or consents before enabling features that involve event content, face matching, or restricted gallery access. Guests may also be shown separate notices or consent flows before using AI Face Find or similar features.

By using Gleamy, you acknowledge that personal data will be processed in accordance with our Privacy Policy and any feature-specific privacy notices or consent flows shown inside the Service. 10. Payment, billing, distance sales, and refunds

Event plans and top-up purchases are charged at the time of purchase. The total price, currency, applicable taxes or fees, selected plan details, and key pre-contract information are shown before payment is completed.

Payments are processed through our payment service providers. By completing checkout, you authorize the charge for the selected event plan or top-up and confirm that the purchase information has been presented to you before payment.

If you are a consumer purchasing online, your purchase may also be subject to our Distance Selling Contract and applicable consumer protection rules. Mandatory consumer rights, including statutory withdrawal rights where applicable, are not limited by these Terms.

Because Gleamy provides digital content and digital services that may be accessed shortly after purchase, we may ask for your express consent to begin supplying the Service before the end of any statutory withdrawal period. Where you give such consent and the Service is performed in line with applicable rules, your withdrawal right may be limited or lost, as described in our Distance Selling Contract and Refund Policy.

Events are time-bound, so refund eligibility depends on your event date, whether digital access has started, the selected event plan, usage level, and applicable law. Refund requests are reviewed under our Refund Policy and mandatory consumer protection rules.

We may change pricing, plan limits, or feature availability from time to time. Price changes do not affect completed purchases for active paid event plans unless required by law or separately agreed with you.

11. Affiliate Program

If you participate in the Gleamy Affiliate Program, your participation is governed by the Affiliate Program Policy in addition to these Terms. The Affiliate Program Policy explains eligibility, affiliate codes, attribution, commissions, disclosure requirements, prohibited practices, payouts, reversals, and termination.

You must not use misleading promotions, spam, unauthorized coupon distribution, self-referrals, false claims, or any other practices prohibited by the Affiliate Program Policy. We may suspend or terminate affiliate participation and decline or reverse commissions where the Affiliate Program Policy is violated.

12. Warranty disclaimer

The Service is provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, non-infringement, availability, compatibility, and accuracy.

We do not guarantee uninterrupted or error-free operation, compatibility with all devices, browsers, networks, camera settings, file formats, or third-party services, or that the Service will meet your specific requirements. If you have questions about compatibility or event-specific needs, contact us before purchasing.

Nothing in this section limits mandatory consumer rights or warranties that cannot be excluded under applicable law.

13. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, business opportunities, or event-related expectations arising from or related to your use of, or inability to use, the Service.

Our total liability for any claim related to the Service will not exceed the total amount you paid for the event plan and any additional purchases, such as top-ups, associated with the event or claim, unless applicable law requires otherwise.

Nothing in these Terms excludes or limits liability for fraud, gross negligence, willful misconduct, death or personal injury caused by negligence where applicable, or any liability that cannot be excluded or limited by law.

14. Account suspension and termination

We may suspend or terminate your access to the Service, restrict certain features, remove content, disable event galleries, or suspend payment-related or affiliate-related features if we reasonably believe this is necessary to protect users, Guests, Event Hosts, participants, Gleamy, the Service, or third parties. Reasons include, but are not limited to:

  • Violation of these Terms, the Affiliate Program Policy, applicable law, or third-party rights
  • Abusive, harassing, fraudulent, misleading, or harmful behavior
  • Uploading illegal, exploitative, unsafe, infringing, or prohibited content
  • Unauthorized resale, redistribution, credential sharing, scraping, or automated extraction
  • Attempts to bypass limits, payment requirements, security controls, consent flows, or access restrictions
  • Payment disputes, chargebacks, suspicious transactions, or risk of abuse

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law, for legitimate business purposes, for security, to resolve disputes, to enforce agreements, or as described in our Privacy Policy.

If your account or event is terminated for cause, you may not be eligible for a refund, subject to mandatory consumer protection laws and our Refund Policy.

15. Dispute resolution

If you have a dispute or concern regarding the Service, we encourage you to first contact us at hello@gleamy.ai or via the contact form on the gleamy.ai homepage. We will make reasonable efforts to resolve the issue informally.

If we cannot resolve the dispute informally, any legal proceedings will be conducted in the courts specified in the Governing Law section below, unless mandatory consumer protection laws in your jurisdiction require otherwise.

Consumers may also have rights to apply to consumer authorities, consumer arbitration committees, mediation mechanisms, or other competent bodies provided by applicable law.

16. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or the Service shall be subject to the jurisdiction of the courts and enforcement offices located in Ankara, Turkey, unless mandatory consumer protection laws in your jurisdiction grant you the right to bring proceedings in your local courts or before another competent authority.

If you are a consumer in the European Union or another jurisdiction with mandatory consumer protection rules, you may have additional rights under those rules, and these Terms do not affect those mandatory rights.

17. Force majeure

We are not liable for any failure or delay in performing obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, government actions, pandemics, power outages, telecommunications failures, cloud provider failures, payment provider issues, cyberattacks, security incidents, strikes, or widespread internet disruptions.

18. Severability and entire agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or competent authority, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent where possible.

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Ayşe Bahar Çelik (operating under the Gleamy brand as a sole proprietorship) regarding the Service. They supersede all prior agreements, understandings, and communications, whether written or oral.

19. Changes to these Terms

We may update these Terms from time to time to reflect changes in the Service, legal requirements, checkout flow, affiliate program rules, privacy practices, or business operations. When we make material changes, we will:

  • Update the 'Last updated' date at the top of this page
  • Notify you via email or through the Service at least 30 days before changes take effect for material changes where practical
  • Provide a summary of key changes where practical

Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you should stop using the Service before the changes take effect.
